What are the audio settings on the Neo? Are they set to passthrough? It could be the AAC audio. You could try transcoding the audio to AC3 using VID2EVA.

YES that did it, set the AAC to HDMI pass-through, had previously played with these settings back think you have to go right back and replay video to get them to take affect?

What video player software you use? I advise you to try another one to play the MP4 video like VLC media player ... In addition, you can download klite codec pack from the internet to see if it can solve your problem, as i ever solved the similar problem for MP4 video ripped from a DVD on Mac ...
